Question About Appealing Property Taxes in 2011

Gwinnett County mailed 256,000 residential notices of current assessment on Friday, April 15, 2011. About 100,000 of the notices are showing a decrease in value, averaging about 23 percent. In total, Gwinnett’s residential properties have lost about $3.3 billion in fair market value county-wide since last year.

I had someone send me a question that I thought was definitely worthy of noting and attempting to answer it.

On our Annual Notice of Assessment, it tells you at the time of filing your appeal, you must select one of the following:

(1)   Appeal to the Board of Equalization (BOE)

(2)   Do an arbitration

I think it’s best to do the BOE rather than arbitration and here’s my reasoning.   Arbitration is final, no appeal, the end of the road, so to speak.  At least with the BOE, you have an appeal route, not that many of you will use the appeal route, but at least, it’s there.  If you don’t like what the BOE has said, you have that option to take it to the Superior Court.

Filing for Homestead Exemption

Homestead exemption helps to reduce the amount of property taxes you have to pay.  Typically, you only have to file one time and it’s good for the rest of the time you own your home.  And most of you have probably already filed for homestead exemption.  However, there are exceptions to that rule, so please read on to make sure you don’t get caught with excessive property taxes.

If you have not already filed for homestead exemption, you must file no later than April 1st to apply to current year for most counties including Gwinnett, Fulton, DeKalb, Cobb, Clayton, Cherokee, Forsyth, Douglas, and Paulding counties.  Jackson county’s deadline is March 1st.

Homeowners may need to provide their social security number, driver’s license and car tag info when filing.  It’s best to review the folloiwng rules and other tips if you have had any changes in the last year.  I was surprised about having to RE-file for homestead exemption in certain instances. 

Rules:

  1. Property owner must own and occupy the property as their primary residence as of January 1 of the tax year.  *** the county does not look at who owned the property the majority of the year – they only look at who owned the property as of January 1.
  2. Property owner cannot be receiving homestead exemption on any other property – this includes properties in other GA counties and other states.
  3. Only one homestead exemption can be claimed between husband and wife.
  4. All vehicles owned by the property owner must be registered in the county where the property owner applies for homestead exemption.

Other Tips:

  1. If the property owner is adding or deleting a person’s name on a deed, they must RE-file for homestead exemption.
  2. If there is a change in ownership, name, or spelling correction on the deed, the property owner must RE-file for homestead exemption.
  3. Refinancing your home does NOT affect your homestead exemption.




Gwinnett County Home Sales Statistics – Updated July 13, 2010

 Home Sales in Gwinnett County, GA were down in May from April and year over year, we were down.  This is not surprising since we knew the home buyer tax credit came to an end on April 30, 2010.Median sales prices were down, but not by much.  And, if you look at the trend in prices since January, you could say it’s seems to be holding rather steady.  Could we be at the bottom of this rocky market here in Georgia?  I hope so.  I am ready to see some trends up these days.

Tour of Homes in Buford, GA

The 12th annual Tour of Homes is scheduled for April 18th from 12:30pm – 5:30pm, 2010 in Buford, GA.  This event is hosted by the Buford Lanier Woman’s Club.  This year’s tour will feature 3 gorgeous homes and a houseboat on Lake Lanier!  Buford, GA is located in North Gwinnett County, GA.  One of the main attractions to this area is Lake Lanier.

Lake Lanier has 692 miles of shoreline just north of Atlanta, GA.  More than 7 million people visit Lake Lanier annually.  There’s plenty to do including boating, swimming, camping, picnicing, and all kinds of walking trails and parks.
