Gwinnett County – More on Appealing Your Property Taxes

By now all property owners in Gwinnett County should have received their Annual Notice of Assessment, which was mailed out to all Gwinnett County residents on April 15, 2011.  If you did not received this notice, have additional questions, or would like to start your appeal process, you can log onto:

Due to the decline in property values in recent years every property owner is being given the opportunity to appeal the value that the county has placed on their property. This is the value that the county uses to determine your property taxes.  If you think your property value is lower than what is stated on the notice, follow the instructions on the notice to begin an appeal. The deadline for submitting your appeal is May 31, 2011.

You will be asked to state what you think your property is worth. If you recently re-financed, you may be able to get an estimated property value from your lender. If you recently purchased your home, the purchase price is probably your best indicator. Please check with your county’s assessment procedure, as mail out dates and response times may vary from county to county.

Question About Appealing Property Taxes in 2011

Gwinnett County mailed 256,000 residential notices of current assessment on Friday, April 15, 2011. About 100,000 of the notices are showing a decrease in value, averaging about 23 percent. In total, Gwinnett’s residential properties have lost about $3.3 billion in fair market value county-wide since last year.

I had someone send me a question that I thought was definitely worthy of noting and attempting to answer it.

On our Annual Notice of Assessment, it tells you at the time of filing your appeal, you must select one of the following:

(1)   Appeal to the Board of Equalization (BOE)

(2)   Do an arbitration

I think it’s best to do the BOE rather than arbitration and here’s my reasoning.   Arbitration is final, no appeal, the end of the road, so to speak.  At least with the BOE, you have an appeal route, not that many of you will use the appeal route, but at least, it’s there.  If you don’t like what the BOE has said, you have that option to take it to the Superior Court.

Gwinnett County, GA Property Tax Assessment & Appeal

Watch Your Mail This Week!  This is the week to be receiving your Gwinnett County, GA Tax Assessment Notice in the mail. 

Yahoo!!  We got ours in yesterday’s mail and they pretty much accepted our appraised  value we sent to them back in February 2010.  Our appraised value has come down over $32,000 from last year!  From a tax perspective, that will certainly help to offset the increase in the milage rate. 

Richard, my husband, owns his office building.  He had also put in a tax assessement change notice, but they rejected his appraised value.  So, now what? 

If they did not accept your aprraised value or you do not agree with their appraised value, you have the right to appeal the value to Gwinnett County, GA Board of Assessors.   The appeal must be mailed or delivered within 30 days from the date of the notice you just received in the mail.

You can appeal to the County Board of Equalization at no cost or choose Arbitration, where there is a fee required.  In order to appeal to the County Board of Equaliziation (the free option), go to www.gwinnett-assessor.com and enter your PIN (Property Identification Number) for your property.  You can find this number on the Notice to Taxpayer you just received in the mail.  Once you enter the PIN, the form will come up, which you can then print and fill out.  You will want all the documentation of the most recent sold properties in your neighborhood.  That’s where I come in.   Call me @ 770-356-4656 or email me @ joan.boudreau@kw.com.  I’d be happy to put together some comparable properties for you to use.

See what’s happening in our area of Gwinnett County, GA.  This is the median price for  Buford, Suwanee, Duluth, and Lawrenceville over the last 12 months.  You can see slight declines from the beginning of this year; however, overall, the trend is looking like it’s begining to stabilize.  May just be a bottom in sight.  Our inventory levels are trending down, which is what we need in order for prices to begin to go up.  For example, in the $140,000 – $159,000 price range, there is 6.8 months of  inventory.  That is to say, if no homes were being listed, it would take 6.8 months to absorb that inventory.  In a balanced market, we typically think of as 4 – 6 months of inventory.  So, in this price range in this particular area of Gwinnett county, it’s almost a balanced market.

How Property Taxes Are Calculated in Gwinnett County, GA

I have had many of you ask about how your property taxes are determined and are they based upon your property’s value?  You bet they are; that’s why I encouraged everyone to take a look at their home’s current tax bill and look at what the tax appraisers office say your home is worth.

Unfortunately, most of our property values in Gwinnett County, Georgia have seen a decline since 2007.  I work North Gwinnett, mostly Duluth, Suwanee, Sugar Hill, Buford and Lawrenceville. I have not yet seen a neighborhood where values haven’t declined in the last 2 years.  Some neighborhoods have declined as much as 25%; others may have only declined 10%.  Remember, real estate is LOCAL.

OK, back to our Gwinnett, GA property taxes.  Our taxes are based upon the assessed value of the property minus any exemptions, then multiplied by the millage rate.  Our assessed value is 40% of the appraised value

If you have filed for Homestead Exemption (which I hope you have), then you get that amount of the homestead exemption off of the assessed value.  There are additional exemptions people can qualify for, but this one is the most common – check with the official Gwinnett County website for additional information on homestead exemptions.

Gwinnett County, in 2010, has increased the millage rate to 13.25 mills (a 2.28 mill increase over 2009 millage rate).  Remember, one mill equals one dollar for every $1,000 of assessed value.

Now, let’s take a simple example.  Assume your property was appraised for $100,000:

  • Appraised Value of Property: $100,000
  • Assessed Value of Property (40% of appraised value): $40,000
  • State Homestead Exemption: $2,000
  • Local Homestead Exemption: $4,000
  • Total Millage Rate: 30 mills (includes a 29.75 local millage rate (10 mills for county and 19.75 mills for board of education) and the 0.25 State of Georgia millage rate)

(Assessed Value – Exemptions) x Millage Rate = Taxes Due
($40,000 – $2,000 – $4,000) x .0300 = $1,020

Your tax bill is calculated based on the assessed value of the property (40% of the appraised value), minus any exemptions, multiplied by the millage rate.

Exemptions for property taxes vary from county to county. The State of Georgia has established a statewide $2,000 Homestead Exemption. In addition, many counties offer additional exemptions for the county residents as well as for the elderly and other special circumstances.

The millage rate is determined by the budgets adopted annually by the county board of commissioners, the county board of education and cities within the county (if the city you live in levies a property tax). A mill equals $1 in tax for every $1,000 of net assessed value. In addition, the state assesses a millage rate in each county of 0.25 mills.

In Gwinnett County, GA, you had until March 1st to do a filing to dispute your property taxes.  Then in mid-April, you will get a letter from the county to say if they agree with what you stated your property value to be.  If you disagree with their assessment, you then have 30 days to file an appeal.

In summary, your property taxes are directly related to what the county says your home is worth.

This is my first post on my first blog.  So, please bear with me as I learn all this new and wonderful technology.  I am new to Facebook, Twitter, LinkedIn, and now Blogging.  I also want to thank Chris Abraham, who gave me step by step instructions on YouTube on “How to Blog Using WordPress“.  Live video instruction and he has gotten me to this point fairly effortlessly.
